Statement on the Employment Tribunal Judgment
The Employment Tribunal judgment, has now been published. In the interests of transparency we are sharing it here in full so that anyone with an interest in these proceedings can read the Tribunal’s findings for themselves.
Following more than two years of legal proceedings, four preliminary hearings, a four-week final hearing and a detailed 197-page judgment, the Employment Tribunal dismissed every claim against Metanoia Institute. The claims brought by five former employees comprised 45 alleged protected disclosures, 45 alleged detriments, four claims of constructive dismissal and one claim of victimisation.
It is important to clarify one point that has featured prominently in public commentary throughout these proceedings. The Tribunal expressly states that claims of race discrimination and race harassment were not among the legal claims it was asked to determine. It therefore made no findings on those matters.
However, in deciding the claims that were before it, the Tribunal did examine in detail the concerns about race raised by the claimants and how Metanoia responded to them.
In reaching its conclusions, the Tribunal considered extensive oral evidence over four weeks, together with thousands of pages of documentary evidence, accumulated during the proceedings. It undertook a detailed examination of how Metanoia responded to the concerns raised by the claimants over an extended period, including the organisation’s handling of complaints, grievances, protected disclosures and other concerns raised during their employment.
Having examined that evidence, the Tribunal found:
“The Respondent made appropriate efforts to understand and address concerns raised.”
The Tribunal further found:
“…the Claimants were often unclear on the basis for their assertions, what (in concrete actionable terms) they wanted to be done, were hypersensitive and had unreasonable expectations of the Respondent.”
These findings are significant because they relate directly to the issues the Tribunal was required to determine; how Metanoia responded to the concerns raised by the claimants and whether its actions gave rise to the legal claims before it. Having considered those matters in detail, the Tribunal determined the claims should be dismissed.
As a responsible organsation, we welcome the Tribunal’s observations concerning aspects of process and governance. Many of these matters have already been addressed through the significant organisational changes implemented over recent years, and we will continue to reflect carefully on the judgment to ensure that any remaining learning is fully embedded.
Throughout the process, Metanoia chose not to litigate these matters in public. We believed then, as we do now, that the proper place for them to be determined was before an independent Employment Tribunal, on the basis of evidence rather than public commentary.
We recognise that these proceedings have been difficult for everyone involved. People can experience and understand the same events differently, and we do not underestimate how strongly those who brought these claims feel about their experiences. We hope that, with the proceedings now concluded and the judgment finalised, everyone involved will be able to move forward.
Our focus now is where it has always been: supporting our students, our staff and our wider community, while continuing to build an organisation that listens, learns and strives continually to improve.
